These Terms and Conditions (“Terms”) apply to your use of trickybytes.com (the “Website”) and to the services provided by TrickyBytes (“TrickyBytes”, “we”, “us” or “our”). By using the Website or engaging our services, you agree to these Terms. If a signed proposal or agreement with you says something different, that agreement takes priority.

1. Our services

TrickyBytes provides Shopify development, CheckoutChamp funnel setup, GoHighLevel automation, WordPress development, custom web development, CRM setup and management, and related support. The exact scope, deliverables, timeline and price for each project are set out in the quote or proposal we send you.

2. Quotes and scope

Quotes are based on the information you provide and are valid for 30 days unless stated otherwise. Work that is not included in the agreed scope, or changes requested after work begins, may require an updated quote or additional fees, which we will confirm with you before starting.

3. Your responsibilities

To deliver on time, we rely on you to provide accurate information, content, feedback and access to the platforms and accounts we need (for example your Shopify, CheckoutChamp, GoHighLevel, WordPress, hosting or CRM accounts). Delays in providing these may affect the timeline. You are responsible for the content you provide and for making sure you have the right to use it.

4. Payments

Payment terms, including any deposit and milestone payments, are set out in your quote. Unless agreed otherwise, invoices are due on receipt. We may pause work on overdue accounts. Monthly management and support plans are billed in advance and can be cancelled with notice as stated in your plan. When you hire us through a marketplace such as Fiverr or Upwork, that platform’s payment and refund rules apply.

5. Revisions and acceptance

Each project includes the revisions described in the quote. Work is treated as accepted when you approve it, when it is launched, or if no feedback is received within 14 days of delivery.

6. Refunds and cancellation

You may cancel a project in writing at any time. You will be charged for work completed up to the cancellation date, and any deposit covering work already done is non-refundable. If we cannot deliver the agreed work, we will refund payments for the parts not delivered.

7. Ownership and intellectual property

Once full payment is received, you own the final deliverables created specifically for you, including custom code, designs and content. We keep ownership of our pre-existing tools, code libraries and know-how, and grant you a licence to use them as part of your deliverables. Third-party themes, plugins, apps and platforms remain subject to their own licences and terms. Unless you ask us not to, we may show non-confidential parts of the work in our portfolio.

8. Third-party platforms

Our work often depends on third-party services such as Shopify, CheckoutChamp, GoHighLevel, WordPress, hosting providers, payment gateways and apps. We are not responsible for outages, changes, pricing or policies of those services, and you are responsible for any subscription fees they charge.

9. Confidentiality

We keep your business information and any data we access during a project confidential and only use it to deliver our services.

10. Warranties

We deliver our services with reasonable skill and care. We fix bugs caused by our work that are reported within 30 days of delivery at no extra cost. We cannot guarantee specific business results such as sales, rankings or conversion rates, because these depend on many factors outside our control.

11. Limitation of liability

To the maximum extent allowed by law, TrickyBytes is not liable for indirect or consequential losses, including lost profits, revenue or data. Our total liability for any claim relating to a project is limited to the amount you paid us for that project. Nothing in these Terms limits liability that cannot be limited by law.

12. Use of the Website

Content on the Website is provided for general information. You may not copy, reproduce or misuse the Website or its content without our permission.

13. Changes to these Terms

We may update these Terms from time to time. The version shown on this page, with its “Last updated” date, applies to new projects from that date.
